How much money
can I get? Lawsuit
loans are generally
limited to about
15% of the projected case value. The minimum
lawsuit loan is $500 -
$1,000. The maximum amount will be
determined on case-by-case basis, but it can be
well over $1,000,000.00.

How long will
it take to receive a lawsuit
loan? We will
generally review your application for lawsuit
funding within 24
hours from the time we receive all necessary
documents from your
attorney.
Once you are
approved and the Funding Agreement is signed,
we will immediately overnight you a check via
FedEx so you will receive the next
day. Depending on your
location, you may also pick up the check
personally.

How much is
the lawsuit loan going to
cost? The fees depend on the nature of
your case but you may be able to receive a
settlement loan for as little as $19 per $1,000 per
month and a lawsuit loan for as little as $35 per
$1,000 per month. Your repayment amount will be
thoroughly explained to you and your attorney prior
to your signing and accepting of the Funding
Agreement. We strongly suggest that you consult
with your attorney before signing the
Agreement.

Do I need to
be represented by a Lawyer to apply for a lawsuit
loan? Yes. You need to have a
pending lawsuit and be represented by an

Is this a
loan? A Lawsuit Loan
is technically not a
loan.
We purchase a portion of your settlement and
advance you the money upfront. This works to
your advantage because if you lose your case, you
owe us nothing as what we purchased simply has no
value.
The risk is on us. A Settlement Loan is a loan
but the only collateral you need is your settled
lawsuit. You do not have to show us
any other financial information, including credit
or employment history.

Is buying a lawsuit
settlement legal?
Yes, in all states other than North Carolina, the
settlement proceeds, minus your attorney fees and
medical liens, belong entirely to you and you can
use it in any way you wish, including assigning it
to third parties. As a matter of fact, you
have probably already assigned a portion of your
settlement to your attorney under a contingency fee
agreement.

Do I have to pay any up
front out-of-pocket fees prior to receiving a
lawsuit or settlement Loan?
No. The
beauty of lawsuit and settlement loans is that you
don’t have to pay anything upfront.
All fees will be processed at the conclusion of
your case, provided you
win.
If you lose, there is nothing to pay.

Is the defendant or his
insurance company notified of my lawsuit or
settlement loan?
No, the only parties who know about the transaction
are you, your attorney and the lawsuit funding
company.
Otherwise, this process is fully
confidential.
- Why don’t I
get a bank loan as opposed to a
lawsuit loan?
Lending money based on pending lawsuits
is considered too risky by traditional financial institutions,
including banks. Your pending lawsuit is not sufficient to
qualify you for a loan. If you have other means of securing
a bank loan – i.e. a home or other assets, you may want to
consider that form of funding before applying for a lawsuit
loan. Due to its high cost, pre
settlement funding should be considered as a last
resort.
- Is CashExpress going to be
involved in my lawsuit after I receive pre settlement
funding? Absolutely not. The lawsuit funding company has no
involvement with the handling your lawsuit
whatsoever. Your case will continue to be
handled exclusively by your attorney.
- Do I have to
disclose all prior settlement loans?
Yes. Most pre settlement funding companies use a
computerized system to verify your prior funding
obligations. Once they find you lied to them they
will most likely not want to do business with you. In
addition, you must attest in your Funding Agreement that
you have no undisclosed prior lawsuit loans. If you
fail to disclose prior funding agreements, you will be
committing fraud and violating the terms of the Funding
Agreement. Once this fraud is discovered, the funding
company can go after you personally and demand you pay them
back before your you win your lawsuit.
